On Thursday, a judge rejected an acquittal request submitted by an American mother accused of killing her three children, according to a court document, weeks after the jury failed to reach a verdict in this case, which received widespread media coverage.
Lindsay Clancy (36 years old) did not deny during her trial that she had suffocated her children Cora (five years old), Dawson (three years old), and Callan (eight months old), but she stressed the need to be exempt from criminal responsibility because she was suffering from postpartum psychosis.
Judge William Sullivan, of Plymouth Court near Boston, deemed the evidence sufficient to convince a member of the jury to convict Clancy.
The judge has not yet ruled on whether she will be subjected to a retrial.
After seven days of deliberations during September, the jury of nine women and three men was unable to reach a unanimous decision, which is required by law in criminal cases in the United States.
Kevin Reddington, Clancy's lawyer, asked the judge to issue an acquittal, which effectively meant dropping the case after a trial that lasted weeks, was broadcast on television, and captured the attention of Americans.
Reddington had previously asked, “Where is the evidence that she committed this crime?” He also questioned Clancy's own confessions that she killed her children, in a radical shift from her defense based on her psychological state.
